TERMS, CONDITIONS, AND POLICIES APPLICABLE TO BUYING A

TICKET THROUGH TIXSA

 

BASIC TERMS

tixsa:

-           Is an independent company providing ticketing services for Clients (as defined below) to sell tickets for specific events to be held/hosted at Venues (as defined below) and acts as an agent between the Client and You; and

 

-           Is not affiliated with any Client or Venue, unless the affiliation is specifically stated on tixsa’s website or other marketing platform

Client is any person or entity which produces and/or administers and/or hosts and/or presents and/or sells tickets for a specific event at a Venue and who makes use of tixsa’s ticketing system platform and technological structures to sell tickets for such event.

Venue is a venue or location where a specific event is held or presented by a Client

You are the buyer of a ticket via a Client’s website and/or any other tixsa platform which may be or become available in the future. 

BASIC TERMS WHEN BUYING A TICKET

When You buy a ticket through tixsa, You agree to all of the following terms, conditions and policies applicable to tixsa’s ticket sales:

1.        Liabilities

Tixsa has no involvement in an event for which tickets are sold through any of its platforms and is therefore not in any way liable for anything which may happen at an event for which tickets are sold or purchased and You assume all risk associated with the attendance of an event for which You buy a ticket. 

2.        Ticket Delivery

Ticket delivery options are event specific and are determined by the Client.  Event specific delivery options are listed on the tixsa website. You assume all risk of ticket loss, theft, delay, damage or destruction during and after delivery of tickets. Tickets sold to You which are lost, stolen, delayed, damaged or destroyed will not be replaced.

 

3.        Cancelled/Rescheduled Events

        Clients or others outside the control of tixsa may cancel or reschedule events. It is at the Client’s discretion whether to refund the ticket price or exchange the ticket for a similarly equivalent event, should a cancellation or rescheduling occur. tixsa is not involved in this decision and will purely facilitate this process by providing instructions on its website (www.tixsa.co.za) on how to exchange event specific tickets, or obtain ticket price refunds, should an event be cancelled or rescheduled.  Service charges and mailing costs will not be refunded in the event of a canceled or rescheduled event.

4.        Pricing,  Availability and Seating

5.1   All event ticket prices are set by the Client, and not by tixsa;

5.2   For most ticket sales tixsa will, for instance, charge between R5 -R10 or a percentage of the face value of each event ticket as a service fee.

5.3   Clients are authorised, by agreement, to facilitate the purchase of tickets on a Client’s own website but by making use of the tixsa processing system.  There may be an additional service fee for event tickets purchased through any tixsa client’s website.

5.4   The number of tickets available to be sold for an event through tixsa is set by the Client, not tixsa

5.5   tixsa will not be liable for ticket over-sales.  Should tickets be oversold by the Client, it will have the discretion as to the method of refund, including but not limited to event price refund, or ticket exchange for a similarly equivalent event. Should over-sale occur, only whole, non-perforated tickets will be refunded or exchanged where physical tickets were issued by the Client through the tixsa system.

5.6   Venue seating charts are provided by the Client, not tixsatixsa is not responsible for incorrect seating information, or ticket holder dissatisfaction with selected seating. Any seating dispute is between You and the Client. Service charges and mailing costs will not be refunded if event tickets are oversold, or if a ticket purchaser is dissatisfied with selected seating.

5.        Lost, Stolen, Destroyed Tickets

Lost, stolen, delayed, damaged, or destroyed tickets will not be replaced or refunded, including tickets lost, stolen, delayed, damaged, or destroyed during or after delivery to ticket purchaser.

6.        Refunds and Exchanges

All sales are final. Please review ticket ordering information carefully prior to ticket purchase. tixsa will not refund or exchange tickets, except in the circumstances discussed under Cancelled/Rescheduled Events above.

7.        Privacy Policy

There may be events for which the Client requires Your personal information. For other events, the Client will, at the time of ticket purchasing, give You the option to provide Your name and contact information, including postal address, email address, and telephone number to it.  Once You opt to provide Your name and contact information to the Client, or purchase tickets to which a Client requires Your personal information, tixsa is not responsible for the Client’s use of such information. Should You opt NOT to provide contact information, You understand and agree that only Your name, province and city of residence will be passed on to the Client.

8.        Order Cancellation

tixsa reserves the right to cancel ticket orders for any reason, not limited to incorrect billing information  and/or fraudulent ticket purchasing.

9.        Resale of Tickets

        Tickets purchased through tixsa are for individual use only and not for resale. Only authenticated tixsa tickets will be accepted by Clients for individual events.

10.     Disputes and legal action

Any dispute declared or legal action instituted by You against tixsa will be governed by the laws of the Republic of South Africa.  In the event of any legal action instituted against tixsa, You agree to the jurisdiction of the Pretoria Division of the High Court and to pay legal costs on an attorney and own client scale, should You be unsuccessful in Your legal action against tixsa.

11.     Export restriction

The offering on this website is available to South African clients only

 

12.     Credit card acquiring and security

Credit card transactions will be acquired for tixsa via PayGate (Pty) Ltd who are the approved payment gateway for ABSA.  PayGate is PCI DSS Level 1 compliant and no credit card details are stored on the website.  Users may go to www.paygate.co.za to view their security certificate and security policy. 

 

13.     Customer details separate from card details
Customer details will be stored by tixsa separately from card details which are entered by the client on PayGate’ s secure site.  For more detail on PayGate refer to www.paygate.co.za

 

14.     Responsibility

tixsa takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

 

15.     Country of domicile

This website is governed by the laws of South Africa and tixsa chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature:

16.     Variation

tixsa may, in its sole discretion, change these terms and conditions or any part thereof at any time without notice.

Effective Date - These terms, conditions and policies are effective as of 1 May 2010.
